Recent Results

Your case is unique and the outcome will depend on many factors. There are no guaranteed results in criminal defense. Here are some positive outcomes I've recently achieved for my clients.

Sexual Assault No Billed- Client was under investigation for sexual assault. The sheriff's investigator wanted him to come down to the station and discuss what happened. Client then retained my services. I spoke with the prosecutor and investigator.

Result- Not Guilty. The case was no billed by the grand jury.

DWI Bench Trial Not Guilty- Client was pulled over for driving on the shoulder. Police report indicated that client had blood shot eyes, slurred speech, and that client failed all 3 field sobriety tests.

Result- Not Guilty. This was an interesting trial in which I suppressed much of the State's evidence against my client.

Motion to Revoke Probation 1st Degree Felony- Client was on deferred adjudication probation and allegedly committed a new felony drug offense.

Result- Motion to revoke withdrawn, client received pre trial diversion on the alleged new offense.

Criminal Trespass- Client allegedly entered private residence (not his) and confronted "victim".

Result- Case dismissed.

DWI 2nd Dismissed- Client pulled over for expired registration. "Fails" field sobriety tests (HGN, Walk and Turn, One Leg Stand).

Results- DWI 2nd dismissed. Client accept deferred probation for obstructing the highway.

DUI Minor- Client was stopped for leaving the scene of an alleged underage drinking party. Client was under 21 and given a DUI minor.

Result- Criminal case dismissed at first hearing. I also won the ALR hearing so the client's license was not suspended.

Felony Probation Revocation - Allegations included new offense, failed drug tests, unpaid fines, and failure to perform community service. Result: motion to revoke dismissed.

DWI Dismissed - Client was stopped for defective head light. Officer smelled the "strong odor of alcohol." Officer alleged that client failed field sobriety tests. Client refused breath test. Result: DWI dismissed. Client pled to Obstructing the Highway, deferred probation.

DWI 2nd Dismissed - Client pulled over for burned out license plate light. Officers lists the usual "slurred speech" and "odor of an alcoholic beverage". Client takes and "fails" field sobriety tests. Client refuses to provide a breath sample.

Result - Case dismissed at pre trial hearing. Client pled to Obstruction of a Highway, deferred adjudication.

Possession of Methamphetamine Dismissed - Client pulled over for illegal window tint. Client arrested for outstanding traffic ticket warrant. Officer searches vehicle and finds methamphetamine in car and on passenger.

Result - Case dismissed. The prosecutor and I agreed that the elements of possession (care, custody, and control) were missing.

Assault Family Violence Dismissed - I set the case for trial. State dismissed on the day of trial.

Telephone Harrassment Dismissed - Defendant allegedy phoned ex girlfriend at work. I spoke with the prosecutor and pointed out that a) this law was declared unconstitutional (by the Fort Worth court of appeals) and b) the alleged conduct would not have violated the law anyway. Result: Dismissed at first hearing.

Cocaine Possession - Client was stopped for a traffic violation. Drug dog called to the scene. Drug dog indicated the presence of narcotics. A search yielded a sizable amount of cocaine. After viewing the video tape I realized that the search was not constitutional. I spoke with the prosecutor who agreed with my conclusion. Result- Case dismissed.

Assault Family Violence - Female defendant with "boyfriend" as victim. Case dismissed at first court appearance.

.122 Breath Test DWI, Pled To Obsruction - Client stopped for speeding. Officer alleges client fails Horizontal Gaze Nystagmus Test. Client takes breath test that indicates .122 bac. Case set for jury trial. Before trial, DWI case is dismissed. Client pleads to obstruction of a highway.

DWI Not Guilty - Client stopped for failing to maintain a single lane. Officer notes that defendant has odor of alcoholic beverage on breath. Client performs and fails 3 standard field sobriety test. Client refuses intoxilyzer test. In trial motion to suppress granted. Judge finds client not guilty.

DWI 2nd Pled To Obstruction of Highway - Client stopped for speeding. Officer notes odor of alcohol on breath and slurred speech. Client fails all 3 field sobriety tests and refuses breath test. Client refused breath test.

Marijuana Case Suppressed - Client was approached by police officer for questioning. Officer pats down client for "officer safety." Officer finds marijuana in pocket. Motion to suppress filed allegeding illegal search by officer. Judge rules that search was illegal, all evidence suppressed.

Marijuana Case Suppressed - Client was pulled over on highway for speeding. Officer asks for permission to search vehicle. Client consents to search. Officer finds marijuana. Motion to suppress filed. Judge rules that search was illegal.

Assault Case Dismissed - Client was arrested for assault at "victim's" residence. State agrees to dismiss case.

Indecency With A Child Dismissed - Client was charged with 3rd degree felony indecency. State agreed to dismiss case.

Marijuana Pre Trial Diversion - Client had misdemeanor marijuana charge. Client received pre trial diversion, avoiding probation and allowing record to be cleared in future.

Motorcycle DWI Pled To Obsruction - Motorcycle driver pulled over for speeding. Client fails field sobriety tests and refuses breath test. DWI dismissed. Client pleads to obstruction of a highway.
